Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to recefve Basic Allowance for Housing (BAH) at the old permanent duty station (PDS) rate. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 3 April 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe Petitioner's application, together with all material submitted in support thereof, relevant portions of the Petitioner's naval record and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 1 March 2016, the Petitioner was issued BUPERS Order . c. On 14 March 2016, the Petitioner detached from the old PDS and reported the same day to the new PDS. d. On 24 February 2018, the Petitioner was separated. CONCLUSION Upon review and consideration ofall the evidence of record, the Board agreed that the Petitioner was not issued any appropriation data and could not move household goods and deserves to retain the BAH that she was receiving. The Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION Petitioner's close proximity move request was approved prior to her transfer 14 March 2016. Petitioner was authorized BAH at the with-dependent rate for from 14 March 2016 to 24 February 2018. Note: ifPetitioner moved from her residence during this period, she will no longer be authorized BAH at the old PDS. Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner's records to determine if Petitioner is due any back pay and allowances. A copy ofthis Report ofProceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board' s proceedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Section 6( e) ofthe revised Procedures ofthe Board for Correction ofNaval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalfofthe Secretary ofthe Navy.
