After careful and conscientious consideration of the entire record, the Board found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 29 March 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion (AO) by NPC memo 1780 PERS-311 of 20 December 2018, which a copy was previously provided to you for comment. You requested the $10,000 NCF Kicker be corrected to $30,000 NCF Kicker. Your application states: "My Navy College Fund (NCF) Kicker to the GI BILL reported to the VA by DOD is approximately $10,000. When l enlisted in 1998, l was told and have a certificate showing the NCF amount to be $30,000, giving me a total of nearly $50,000 for college. Looking at all the historical messages (oldest one I could find is 2003), all state the 'Total NCF benefit (kicker + GI BILL) is $50,000. l request the $10,000 NCF Kicker be corrected to $30,000 CF Kicker." Your application further states, "I was told by the recruit command that I was receiving approx $50,000 in college funds ($30K NCF + $19K GI BILL). Once I started using my benefits in 2017, I was informed I received the GI BILL plus $1OK kicker. All research on my end has total amounts (GI Bill + NCF) to be either $40K or $5OK depending on your specific contract. Iw as contracted AIRR and NCF. According to the 2003 GENADMIN (oldest message I could locate) the total NCF for ATRR was $SOK which backs up what 1 was told when I enlisted." The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. The Board concluded that you received your entitlement to the NCF for your service in the U.S. Navy and substantially concurred with the comments contained in the AO. The Board noted that your NCF benefit was a combination of the NCF "kicker" payment and the Montgomery GI Bill (MGIB). Furthermore, the Board found that the MGIB and the NCF kicker amounts, which together can total upwards of $50,000.00, and became effective in 2003 did not apply to you as you entered active duty in the Navy on 3 June 1999, when the MGIB and the NCF kicker amounts together totaled $30,000.00 for your rating at that time and not $30,000.00 solely for the NCF. It is regretted that the circumstances of your case are such that favorable action cannot be taken at this time. You are entitled to have the Board reconsider its decision upon the submission of new and material evidence. New evidence is evidence not previously considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
