Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to a zone "B" Selective Reenlistment Bonus (SRB) via the Obligated Service to Train (OTT) program. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 29 June 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department ofthe Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration ofall the evidence ofrecord, and especially in light of the contents ofenclosure (2), the Board finds the existence of an injustice warranting the following corrective action: The purpose ofthe OTT program is to allow members to obtain sufficient OBLISERV to complete a SRB qualifying school. Since Petitioner's current EAOS was before the graduation date and the HM/8708 had a valid SRB award level, Petitioner was eligible to apply for the OTT program. Petitioner should have been allowed to execute an OTT reenlistment and then reenlist upon graduation for an SRB, at the award level in effect at the time of the agreement or at the award level in effect at reenlistment, whichever is higher. Unfortunately, BUPERS 328 has no record of an OTT request. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The 2 year reenlistment, executed on or about 22 May 2008, is modified to reflect "conditional for the OBLISERVE To Train (OTT) program option." The 24 month agreement to extend enlistment (NAVPERS l 070/621) executed on 29 May 2008 is null and void. The 23 month agreement to extend enlistment (NA VPERS l 070/621) executed on 13 April 2010 is null and void. Petitioner was discharged and reenlisted on 14/15 May 2010, vice on or about 21122 May 2010. The tenn was 5 years vice 4 years. This change will entitle the Petitioner to a zone "B" SRB with an award level of 3.5 ($45,000 award ceiling) for the HM/8708 rate/NEC. The agreement to extend enlistment (NA VPERS 1070/621) executed on 17 September 2012 was for a tenn of2 months vice 14 months. Note: Petitioner executed an immediate reenlistment contract (NA VPERS 1070/601) on 30 January 201 5, for a term of 6 years. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4.
