Pursuant to the provisions of the reference, Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board. requesting that his naval record be corrected to establish his entitlement to a Zone "B" Selective Reenlistment Bonus (SRB). 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 29 January 2019 and, pursuant to its regulations, detem1ined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner's naval records, and applicable statutes. regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, the Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. On 22 August 2014, Petitioner executed an agreement to extend his enlistment for 9 months to meet obligated service requirements. See enclosure (2). c. On 20 September 2016, Petitioner's detailer notes indicate a request for AEGIS School. See enclosure (3). d. NAVADMIN 212/16 (Selective Reenlistment Bonus Update) of 20 September 2016 provided that the SRB level for the FCA rating, Zone "B" was an award level of 4.0 ($75,000 award ceiling). See enclosure (4). e. NAVADMIN 284/16 (Selective Reenlistment Bonus Update-corrected copy) of 21 December 2016 provided that the SRB level for the FC AEGIS rating, Zone "B" was an award level of 3.0 ($75,000 award ceiling). See enclosure (5). f. On 20 March 2017, Petitioner received official change of duty orders (BUPERS Order: 0797) with service obligated to December 2020. See enclosure (6). g. On 27 April 2017, Petitioner's SRB was approved. See enclosure (7). h. On 1 May 2017, Petitioner reenlisted for 6 years with an EAOS of 15 October 2017/SEAOS of 15 July 2018. Furthermore, a NAVPERS 1070/613 (Administrative Remarks) was published directing a SRB for the FC rating of Zone "B." See enclosure (8). i. On 15 June 2017, Petitioner received an official modification to his change of duty orders with service obligated to February 2021. See enclosure (9). j. NAVADMIN 144/17 (Selective Reenlistment Bonus Update) of 21 June 2017 provided that the SRB level for the FC AEGIS rating, Zone "B" was an award level of 3.0 ($75.000 award ceiling). See enclosure (10). k. On 12 August 2017, Petitioner transferred. See enclosure (11 ). l. On 10 October 2017, Petitioner graduated from . See enclosure (12). m. NAVADMIN 311/17 (Selective Reenlistment Bonus Update December 2017) of 22 December 2017 provided that the SRB level for the FC AEGIS rating, Zone "B" was an award level of 3.0 ($75,000 award ceiling). See enclosure (13). n. On, NAVADM 032/18 "B" (Selective Reenlistment Bonus Update February 2018) of 15 February 2018 provided that the SRB level for the FC AEGIS rating, Zone "B" was an award level of 3.0 ($75,000 award ceiling). The NAVADMIN further provided that FC AEGIS 0000 SRB eligibility was contingent upon graduation from an FCA NEC-awarding "C" School. See enclosure (14). o. On 4 May 2018, Petitioner graduated from AEGIS computer network technician B/L 9(A­150-9020) (NEC V69A) at . See enclosure (15). p. On, NAV ADMIN 119/18 (Selective Reenlistment Bonus Update May 2018) of 14 May 2018 provided that the SRB level for the FC AEGIS rating, Zone "B" was an award level of 4.5 and Zone "C" 0.0 ($75,000 award ceiling). See enclosure (16). q. On 27 May 2018, Petitioner passed through Zone "B". See enclosure (11). r. On 11 June 2018, Petitioner's SRB approval was canceled. See enclosure (17). s. On 29 June 2018, Petitioner graduated from CEC AN/USG-2B technician (NEC V51A). See enclosure (18). t. In enclosure (19), BUPERS provided an advisory opinion (AO) concluding that the evidence proffered by Petitioner is insufficient to support the requested record change. The AO noted that Petitioner did not execute a 19-month extension for the OBLISERV requirements, but reenlisted on I May 2017 for 6 years instead. Petitioner was awarded a Tier 1, Zone B, FC/0000, 1.0 SRB award for the 1 May 2017 reenlistment. The FC/0000 and the FCA are two separate rates. Since Petitioner was converting from the FC/0000 to the FCA rate they were not eligible for the SRB. Reference (h) [SRB cancellation message DTG 1102082 JUN 18] was released canceling reference (g) [SRB approval message DTG 2701332 APR 17]. DFAS Cleveland has been notified to begin recoupment process ... Member states that their school graduation date was 4 May 2018. Reference (c) [SUPERS order modification 0797 dated 15 June 2017] does not list a graduation date of 4 May 2018. While the member's rate is changed upon issuance of PCS orders to conversion process is not complete until completion of the FCA pipeline. The final graduation date listed on reference (d) [MILPERSMAN 1306-106] is 15 June 2018. On 15 June 2018 Petitioner is in Zone C for SRB purposes. Reference (f) [NAVADMIN 119/18] list the Zone C SRB for the FCA rate is 0.0. CONCLUSION Upon review and consideration of all the evidence of record, and notwithstanding the opinion expressed in enclosure (19), the Board finds the existence of an error or injustice warranting corrective action. Petitioner was ill-advised to execute reenlistment since he could have executed an extension in order to meet his new obligated service requirement of February 2021. The Board concluded that the graduation certificate, Enlisted Master File (Member Data Summary), Personnel Online Listing (POLL), and school listing from PERS-406 show that Petitioner completed the FC AEGIS pipeline training requirements by 4 May 2018. Petitioner could have executed reenlistment on 4 May 2018 for a term of 6 years and receive entitlement to a Zone "B" SRB for the FC AEGIS rating. Therefore, the Board concluded that Petitioner was entitled to execute reenlistment on 4 May 2018 for a term of 6 years since he met the SRB eligibility requirements (FC AEGIS 0000 SRB eligibility contingent upon graduation of an FCA NEC-awarding "C" School) per NAVADMIN 032/18. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner executed a 19-month agreement to extend his enlistment (NAVPERS 1070/621 ), effective on 16 July 2018. Petitioner was discharged and reenlisted on 3/4 May 2018, rather than 30 April/1 May 2017, with a term of 6 years. Note: This change will entitle Petitioner to a Zone "B" SRB with an award level of 3.0 ($75,000 award ceiling) for the FC AEGIS rating. Remaining obligated service to 15 July 2018 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4.
