Pursuant to the provisions ofreference ( a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to retroactive Special Duty Assignment Pay (SDAP). 2. The Board, consisting of reviewed Petitioner's allegations oferror and injustice on 27 April 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence ofrecord, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action: The Petitioner was eligible for SDAP entitlement while serving as a Nuclear Plant Supervisor onboard However, an administrative oversight provided the Petitioner with a monthly payment of SD-1 vice the correct SD-5. This error led to an erroneous monthly SDAP payment of$75 from 11 September 2015 to 30 September 2016. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner was entitled to SDAP while assigned as Nuclear Plant Supervisor (NEC 3364), from 11 September 2015 to 30 September 2016, at (Defense Finance and Accounting Service), Petitioner SDAP level SD-5 at the rate of $375.00 per month stopped on 10 September 2015. Furthermore, from 11 September 2015 to 30 September 2016, Petitioner received SDAP level SD-1 at the rate of $75.00. Finally, Petitioner SDAP level SD-5 at the rate of $375.00 per month started on 1 October 2016. The final payment will be determined by Defense Finance and Accounting Services. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4.
