Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to retroactive Special Duty Assignment Pay (SDAP). 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 26 April 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitions naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cogninzance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light ofthe contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner checked onboard his command 24 May 2017. He was qualified as MH-60R Multi Mission Helicopter Aircrewman (NEC 7875/G l lA) in June 2010 for the billet he was filling, and therefore eligible to receive Special Duty Assignment Pay (SDAP). However, Petitioner's administrative personnel failed to take the necessary action(s) required to have his special pay started which resulted in a failure ofPetitioner receiving his SDAP. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: Petitioner was entitled to SOAP while assigned as MH-60R Multi Mission Helicopter Aircrewman (NEC 7875/G 1 lA), (Command Rescue Swimmer), onboard Helicopter Strike Squadron FOUR ONE (HSM 41) (UIC 55138), from 1 June 2017 to 30 September 2017, at SOAP level SD-3 at the rate of $22.5.00 per month. Note: The final payment will be determined by Defense Finance and Accounting Services. A copy ofthis Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation ofauthority set out in Section 6(e) ofthe revised Procedures of the Board for Correction of Naval Records (32 Code ofFederal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalfofthe Secretary ofthe Navy.
