Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to add awards points on the profile sheet for the August 2016 Navy Wide Advancement Examination (NWAE) Cycle 099 and advancement to E-6. 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 15 May 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted of the enclosures, relevant portions of your naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. CONCLUSION Upon review and consideration ofall the evidence of record, the Board agreed the Petitioner should have rated awards points on his Cycle 099 NWAE profile sheet for one Navy and Marine Corps Achievement Medal dated 26 August 2012 worth 2 awards points and for one award NAYADMIN 280/06 or 141/07 dated 6 October 2012 worth 2 awards points; for a total of 4 awards points. The Board does not agree with the Petitioner that his profile sheet should have also included one Navy and Marine Corps Achievement Medal worth two points dated 30 August 2016. The Board agrees that reference (b) states awards points can only be entered for awards approved or earned prior to the day of the regularly scheduled examination. The Petitioner took the NWAE on 1 September 2016 which is not the regularly scheduled examination date. In addition, the Board agrees the award issuance date of 30 August 2016 cannot be before the period end date of October 2016. In addition, The Board finds the existence of an injustice warranting the following partial corrective action. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The Petitioner's Examination Profile Information and Exam Status sheet from the August 2016 Cycle 99 Navy Wide Advancement Exam (NWAE) is modified to read Awards is "4" vice "2", and FMS (Final Multiple Score) is "163.43" vice "161.43". Note: the Minimum Multiple Required was 164.10. In so far as Petitioner's request for corrective action that exceeds the foregoing, the Board concurred that the Petitioner did not meet the minimum FMS required to be advanced to MA1/E-6 from Cycle 099 NWAE. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4.
