Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to request for Cycle 236 retroactive advancement to MMW1 due to missing substantiating records. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on April 19, 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner's naval record, and applicable statutes. regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On May 7, 2007, Petitioner completed Associates Arts degree. c. On April 17, 2017, NAVADMIN 070/17 released with requirements for September 2017 (Cycle 236) Navy-Wide Petty Officer (E4-E6) Advancement Examination (NWAE). d. On Nov 11, 2017, Petitioner's individual profile for September 2017 (Cycle 236) reflects Education Points 0.00. Final Multiple of 168.56 and Minimum Multiple Required of 170.27. Status: PNA-PTS 0.0/1.5 e. On Nov 28, 2017, Joint Service Transcripts certifies Associates Arts Degree of 2007. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that the Petitioner had earned 2 education bonus points prior to the cutoff dates per reference (b ), which adjusted the Petitioner's FMS prior to the day of the regularly scheduled September (Cycle 236) NWAE. The Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The Petitioner's Examination Profile Information and Exam Status sheet from the September 2017 Cycle 236 NW AE is modified to read Education Points "2.0" vice "0.00" with the FMS (Final Multiple Score) is "170.56 "vice "168.56". Note: Minimum Multiple Required score was 170.27. The Petitioner was advanced to MMW1 effective June 16, 2018 with a TIR of January 1, 2018. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner's records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6( e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
