Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to transfer two retirement points from one anniversary year to another. 2. The Board, consisting ofreviewed Petitioner's allegations of error and injustice on 4 May 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner's naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner was commissioned as a Second Lieutenant in the U.S. Marine Corps Reserve upon his graduation from the United States Naval Academy on 26 May 1999. c. Petitioner was augmented in the U.S. Marine Corps on 13 August 2003. d. Petitioner resigned (intradepartmental transfer) his commission in the U.S. Marine Corps on 10 June 2009, and transferred to the Individual Ready Reserve (IRR). e. Petitioner joined the Selected Marine Corps Reserve on 14 September 2010. f. On 5 January 2018, OIC, Ready Reserve, IPAC, Marine Forces Reserve stated the following: "There is a system glitch that seems to mainly apply to Officers where a prior active duty officer (comp code 11) or/and with prior "reserve" time (service academy/SMCR) joining to the IRR does not correctly populate the CRCR. Marines can go years without identifying an erroneous start date." CONCLUSION Upon review and consideration ofall the evidence of record, the Board concludes that Petitioner's request warrants favorable action. The Board found the Petitioner participated in good faith with an understanding that he was required to attain a minimum of 50 points within his anniversary year ending 29 June of each year. Subsequently, an error was found and the Petitioner's anniversary was adjusted to reflect on 25 May, resulting a shift of points, which contributed the loss of a qualifying year (30 June 2010 to 29 June 2011). Nevertheless, the Board felt that under these circumstances, a measure of relief is warranted. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The Petitioner completed all training and administrative requirements to include 50 points for the anniversary year ending 25 May 2011. Note: to accomplish this, two points must be transferred from the anniversary year ending 25 May 2012, as necessary. A copy of this Report of Proceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter.
