Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to an Enlistment Bonus for Source Rate (EBSR). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 28 June 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitions naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. On 15 June 2015, Petitioner signed an Enlistment Guarantee (NAVCRUIT 1133/62) Annex A for the Aviation Structural Mechanic (AM) rating for a Class “A” School Guarantee and no other guarantees. Thereafter, Petitioner was reclassified prior to entering active duty into the Advanced Technical Field Aircrew - Rescue Swimmer (ATF/AIRR) rating Challenge Program, with Enlistment Bonus for Source Rate (EBSR) of $8,000 signing the Annex on 31 August 2015 and erroneously dating the Annex B to the DD Form 4 as “15 June 2014”. Due to the erroneous discrepancy to the date used for the Annex B to the DD Form 4, it has impeded Petitioner from receiving the $8,000 EBSR for the ATF/AIRR Challenge Program his Enlistment Bonus Statement of Understanding guaranteed him, and the COMNAVCRUITCOM message 302010Z JAN 15 stating Petitioner’s rating was eligible to receive. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s NAVCRUIT 1133/52, Enlistment Guarantees, for Advanced Technical Field Aircrew - Rescue Swimmer (ATF/AIRR) Challenge Program signed on 31 August 2015 is modified to reflect “Annex B to the DD Form 4 dated 15 June 2015”, vice “Annex B to the DD Form 4 dated “15 June 2014”. The Navy Personnel Command (PERS-811), PSD , or , will pay the EB entitlement as appropriate (provided all EB criteria have been met). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
