Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner’s September 2017 (Cycle 236) Navy Wide Advancement Examination (NWAE) reflected education points. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 3 September 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 31 January 2015, Petitioner was awarded an Associate Degree from Community College of the City . c. In September 2017, Petitioner participated in the September 2017 (Cycle 236) NWAE and passed not advanced (PNA). CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. Petitioner would have been advanced to E-4 if his education points were included in his final score. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's Examination Profile Information and Exam Status sheet from the September 2017 (Cycle 236) Navy Wide Advancement Exam (NWAE) is modified to read Education Points is "2" vice "0", and FMS (Final Multiple Score) is "92.12" vice "90.12". Note: the Minimum Multiple Required was 90.02. Petitioner was advanced to E4 effective "16 June 2018", with a time in rate (TIR) of "1 January 2018”. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
