Pursuant to the provisions ofreference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (I) with this Board requesting, in effect, that the applicable naval record be corrected to modify an immediate reenlistment contract. 2. The Board, consisting of , reviewed Petitioner's allegations oferror and injustice on 30 March 2018 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence ofrecord. Documentary material considered by the Board consisted ofthe enclosures, relevant portions of Petitioner's naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts ofrecord pertaining to Petitioner's allegations of error and injustice, finds that before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations withln the Department of the Navy. CONCLUSION Upon review and consideration ofall the evidence ofrecord, and especially in light ofthe contents ofreference (2), the Board finds the existence ofan injustice warranting the following corrective action: The Petitioner submitted a reenlistment request with the intent to sellback 30 days ofaccrued leave upon executing a 6 year reenlistment contract on 14 December 2017. Due to an administrative error, the Petitioner's reenlistment contract reflected a Lump Sum Leave (LSL) sellback ofOO.O days vice 30.0 days. Hence, the Petitioner did not receive payment. RECOMMENDATION That Petitioner's naval record be corrected, where appropriate, to show that: The immediate reenlistment contract (NAVPERS 1070/601), executed on or about 14 December 2017 is modified to read: LSL Sellback "30.0" vice "00.0". Note: Petitioner's leave balance will be reduced by 30 days, and he will be entitled to payment for 30 days ofleave. A copy ofthis Report ofProceedings will be filed in Petitioner's naval record. 4. It is certified that quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record ofthe Board's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6( e) ofthe revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority ofreference (a), has been approved by the Board on behalf ofthe Secretary ofthe Navy.
