After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 3 December 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. On 11 February 2016, you were issued BUPERS Order . On 21 June 2016, your first household goods (HHG’s) were picked up at weighing 9,697 pounds. On 22 June 2016, your unaccompanied baggage (UB) was picked up weighing 679 pounds. On 3 October 2016, your non-temporary storage (NTS) was picked up in weighing 6,800 pounds. On 31 January 2018, you were notified by the HHG Audit Team that you exceeded your authorized weight limit of 13,000 pounds by 2,731 pounds resulting in an excess cost of $1,157.92. You request your indebtedness to the Government to be corrected or nullified. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. The Board could not identify the furniture you stated was not yours from the inventory sheets provided. Addition, you provided no pictures of any bales of brown wrapping paper wrapped with white string as asserted. Lastly, the Board reviewed the pictures you provided as [trash], which appeared to be a few empty water bottles and plastic materials. The Board concluded that your assertions, pictures, and supporting materials submitted did not support the excess weight for your HHGs. Financial hardship may be considered for remission of this debt. If you seek remission of this debt, you should request such remission from OPNAV N130C at NXAG_N130C@navy.mil. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records.
