After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 30 July 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. You requested to correct your Certificate of Release or Discharge from Active Duty (DD Form 214). The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, such as your assertions that your DD Form 214 shows you entered active duty on 1 June 1984, entered the delayed entry program (DEP) in October 1981, and went to boot camp in January 1982 and graduated in April 1982. Your record reflects that you entered active duty on 15 January 1982 and reenlisted on 1 June 19841. You were issued your final DD Form 214 on 31 March 2004, which reflects your 2 years, 4 months, and 17 days for your prior active service [block 12d of DD Form 214]. The Board also reviewed your assertion that you actually entered the DEP in October 1981 however, the Board noted that DEP time is not active duty service, which why your DEP time is not reflected on your DD Form 214s. The Board concluded that your active duty entry date of 15 January 1982 is correct as indicated on your first DD Form 214. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
