Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show adjustment of Pay Entry Base Date (PEBD). 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 30 August 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 30 November 1989, Petitioner enlisted in the U.S. Navy Reserve for 8 years. c. On 28 April 2004, Petitioner was discharged. d. On 31 October 2007, Petitioner reenlisted in the U.S. Navy Reserve for 6 years. e. On 30 October 2013, Petitioner was discharged. f. On 23 March 2017, Petitioner reenlisted in the U.S. Navy Reserve for 6 years. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that there were two breaks in service (29 April 2004 to 30 October 2007 and 31 October 2013 to 22 March 2017), which were not properly calculated when PEBD was adjusted to 6 March 1994 upon re-affiliation with the U.S. Navy Reserves. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed an enlistment/reenlistment document on 23 March 2017 for 6 years with a PEBD of 23 October 1996. Note: Petitioner’s High Year Tenure will be adjusted accordingly. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
