After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 31 July 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion (AO) by Navy Recruiting Command 1133 Ser N35 dated 12 June 2019, which a copy was previously provided to you for comment. You requested advacement to the paygrade of SK1 (E-6), vice SN (E-3) on your Honrable Dischage Certificate. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. The Board concluded that your permanent paygrade of E-3 should remain on your Honrable Dischage Certificate. You were dischaged from the Air Force Reserve on 1 November 1976 in the paygrade of E-6. On 28 August 1979, you entered the Navy Reserve with a permanat paygrade of E-3, and a temporary paygrade of E-6. According to the administrtive remarks signed at the time of in-processing, it indicates that your temporary paygrade of E-6 can become a permanent paygrade upon completion of the following requirements: E-6 must sucessfully complete the military requirement correspondence course for Petty Officer 3rd and 2nd Class and Petty Officer 1 Class and Chief, in addtion to the professional correspondance course for Petty Officer 3rd and 2nd Class and Petty Officer 1st Class and Chief i.e. MR PO1&C/YN3&2. There was no evidence provided by you nor placed in your Official Military Personnel File that reflects the completion of the following military requirement correspondances. In this connection, the Board substantially concurred with the comments contained in the AO. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
