Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to retroactive Special Duty Assignment Pay (SDAP) from 16 April 2014 through 14 December 2018. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 7 February 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants partial favorable action. c. On 28 January 2020, Petitioner concurred with the partial recommendation to the Board outlined in enclosure (2). d. Petitioner was assigned to PCU () on 16 April 2014 for duty “Commissioning and Fitting Out”. e. Petitioner earned Shipboard Engineering Plant Program Manager (Top Snipe) Navy Enlisted Classification (NEC) 4206 on 1 September 2014. f. Petitioner was issued a designation letter from authorizing him to perform the duties as Top Snipe (NEC 4206) on 30 October 2015. g. Petitioner was assigned to () on 11 November 2015. h. Master Military Pay Account (MMPA) indicates Petitioner received SDAP level SD-1 at the rate of $75.00 per month from 11 November 2015 through 30 June 2018. i. Petitioner was issued a designation letter from authorizing him to perform the duties as Top Snipe (NEC 4206) on 17 February 2017. j. On 5 November 2017, requested Personnel Support Activity Detachment change Petitioner’s SDAP level to SD-3 effective 16 April 2014. k. MMPA indicates Petitioner received SDAP level SD-3 at the rate of $225.00 per month from 1 July 2018 through 14 December 2018. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. In accordance with references (b) and (c), Petitioner met the eligibility criteria to receive SDAP. However, Petitioner’s SDAP level was erroneously processed as SD-1 vice SD-3 from 11 November 2015 through 30 June 2018, resulting in underpayment of $150.00 per month during this period. Conversely, the Board was unable to determine eligibility for 16 April 2014 through 10 November 2015, based on the documents provided by Petitioner. Therefore, the Board found that under these circumstances, a measure of partial relief if warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was entitled to SDAP while assigned as Shipboard Engineering Plant Program Manager (NEC: U16A/4206), onboard , during the period of 11 November 2015 through 30 June 2018, at SDAP level SD-3 at the rate of $225.00 per month vice SD-1 at the rate of $75 per month. Note: Defense Finance and Accounting Service will complete an audit of Petitioner’s pay record to determine retroactive pay entitlement. The part of Petitioner’s request for corrective action that exceeds the forgoing is denied. Petitioner failed to provide evidence of not being properly compensated from 16 April 2018 through 10 November 2015. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
