Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board) requesting, in effect, that the applicable naval record be corrected to establish entitlement to a Zone “B” Selective Reenlistment Bonus (SRB) and to sell back 30 days of use or lose leave. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 19 July 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitions naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action: Per COMNAVPERSCOM SRB Approved msg DTG 090053Z JUL 18, Petitioner was authorized to reenlist for a Zone B SRB at award level 1.5. Petitioner reenlisted on 17 July 2018 for a term of 5 years with the intent of receiving an SRB. However, Petitioner’s Command Career Counselor failed to submit a Career Waypoints (C-WAY) quota request to BUPERS-33 in order to receive an approved quota for Petitioner prior to his reenlistment. Due to this error, Petitioner’s approved SRB authorization was cancelled making Petitioner ineligible to receive the Zone B SRB he was previously approved to receive. Additionally, when Petitioner reenlisted on 17 July 2018, he requested to sell back 30 days of annual leave. However, Petitioner transferred from the command and the local Personnel Support Detachment or Activity was unable to process the request. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Career Waypoints (C-WAY) request was submitted, received and approved by cognizant authority via Chief of Naval Personnel prior to Petitioner's requested reenlistment date of 17 July 2018 for a term of 5-years. On 17 July 2018, Petitioner executed a NAVPERS 1070/601, Immediate Reenlistment Contract for a term of 5 years. Note: This entitles the member to a Tier Three, Zone B SRB with an award level of 1.5 ($30,000 award ceiling) for the GM/0000 rating/NEC. Petitioner’s NAVPERS 1070/601, Immediate Reenlistment Contract, executed on 17 July 2018 for a term of 5 years, is modified to read: “LSL SELLBACK: 30.0”. This change will entitle Petitioner to a lump sum payment for accrued leave of 30.0 days. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
