Pursuant to the reference, Petitioner, a former enlisted member of the Navy, filed the enclosure with the Board for Correction of Naval Records (Board) requesting that his DD 214 issued on 26 August 2002 be removed from his records and the DD 214 issued on 17 July 2002 be reinstated. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 12 August 2019, and pursuant to its regulations, determined that corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosure, relevant portions of his naval records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner enlisted in the Navy and began a period of active service on 8 June 2000. On 10 July 2002, he was recommended for discharge due to a Personality Disorder. On 17 July 2002, he was discharged from his ship with an honorable discharge and issued a DD 214. Subsequently, he was assigned to shore duty for six weeks, discharged with a general discharge and issued a DD 214 on 26 August 2002. c. Petitioner’s 17 July 2002 characterization of service was based on the administrative separation executed by his command, USS . No records were found of administrative separation executed by his shore command. CONCLUSION Upon review and consideration of all the evidence of record, the Board concludes that Petitioner’s request warrants relief. The Board’s decision is based on Petitioner’s original administrative separation. The Board found he was lawfully discharged from the Navy with an Honorable characterization of service on 26 August 2002 and determined to remove both previous DD-214s from petitioner’s record, issue a new DD-214 with discharge date of 26 August 2002, Honorable characterization of service, Secretarial authority for discharge, and re-enlistment code of RE-4. RECOMMENDATION In view of the foregoing, the Board finds the existence of an injustice warranting the following corrective action: That Petitioner’s two DD-214 in his naval record be removed. That Petitioner be issued a new DD-214 reflecting that he received an “Honorable” discharge characterization of service on 26 August 2002. That Petitioner’s new DD-214 reflect that the narrative for separation is “Secretarial Authority and that the separation code is “JFF.” That Petitioner’s new DD-214 reflect that the separation authority is “MILPERSMAN par. 1910-164. That Petitioner’s new DD-214 reflect that Petitioner’s re-enlistment code is RE-1. That a copy of this Report of Proceedings be filed in Petitioner’s naval record. That no further relief be granted. That, upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received by the Board on 5 January 2018. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
