Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to an Enlistment Bonus for Source Rate (EBSR). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 28 June 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitions naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. On 21 September 2016, Petitioner signed an Enlistment Guarantee (NAVCRUIT 1133/62) Annex A for the Hospital Corpsman (HM/5YO) rating Class “A” School Guarantee and no other guarantees. Thereafter, Petitioner was reclassified prior to entering active duty into the Advanced Technical Field Special Warfare Operator (ATF/SO) rating Challenge Program, with Enlistment Bonus for Source Rate (EBSR) of $12,000 signing the Annex B on 23 November 2016. Furthermore, Petitioner was reclassified once he entered active duty and during Recruiting Training Command (RTC) into the Advanced Technical Field Navy Diver (ATF/ND) rating Challenge Program, with EBSR of $8,000 signing the Annex C on 5 February 2018. Per COMNAVCRUITCOM message 081652Z FEB 18, paragraph 3 stated, “This message replaces reference (a), COMNAVCRUITCOM message 301808Z MAY 17, for any Future Sailors initially classified or reclassified on or after 20 DEC 2017.” The message made Petitioner eligible to receive the $8,000 EBSR. However, due to the Classifier omitting the EBSR as Option 2 on Petitioner’s Annex C listing it as “N/A” vice EBSR $8,000 Bonus, it has impeded Petitioner from receiving the $8,000 for the ATF/ND Challenge Program the COMNAVCRUITCOM message 081652Z FEB 18 stated Petitioner’s rating was eligible to receive. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed NAVPER 1133/52, Enlistment Guarantees, Annex C to DD Form 4 dated 21 September 2016 with the following guarantees: Option 2 “Enlistment Bonus for Source Rate (EBSR) $8,000 Bonus” vice “N/A”. The Navy Personnel Command (PERS-811), PSD Charleston, or Ballston Spa, New York will pay the Enlistment Bonus (EB) entitlement as appropriate (provided all EB criteria have been met). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
