Pursuant to the provisions of the reference, Petitioner, a former enlisted Marine, filed the enclosure with the Board for Correction of Naval Records (Board) requesting a change to his Certificate of Release or Discharge from Active Duty (DD Form 214) to reflect his entitlement to the Purple Heart Medal and correct his date of birth. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 19 December 2019, and, pursuant to its regulations, determined the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the enclosure was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the Marine Corps on 29 October 1948 and served until honorably discharged on 29 August 1952. His DD Form 214 lists the following awards: Good Conduct Medal, Korean Service Medal with three stars, and the United Nations Ribbon. d. A letter in Petitioner’s record dated 13 October 1980 indicates he is entitled to wear the Purple Heart Medal for a wound sustained in action against the enemy on 17 August 1950 in Korea while a member of the Marine Corps. e. A review of Petitioner’s record on 9 December 1991 shows he is entitled to the following awards: Good Conduct Medal, National Defense Service Medal, Korean Service Medal with three bronze stars, United Nations Service Medal, Rifle Sharpshooter Badge, Expert Pistol Badge, Republic of Korea Presidential Unit Citation, and the Presidential Unit Commendation Ribbon with bronze star. official military personnel file. CONCLUSION: Upon review and consideration of the evidence of record, the Board determined Petitioner’s request warrants relief. The Board determined Petitioner is entitled to wear the Purple Heart Medal, Good Conduct Medal, National Defense Service Medal, Korean Service Medal with three bronze stars, United Nations Service Medal, Rifle Sharpshooter Badge, Expert Pistol Badge, Republic of Korea Presidential Unit Citation, and the Presidential Unit Commendation Ribbon with bronze star. The Board determined there is insufficient evidence warranting achange to Petitioner’s date of birth. RECOMMENDATION: In view of the above, the Board directs the following corrective action: Petitioner be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215), to indicate the addition of the Purple Heart Medal, National Defense Service Medal, United Nations Service Medal, Rifle Sharpshooter Badge, Expert Pistol Badge, Republic of Korea Presidential Unit Citation, and the Presidential Unit Commendation Ribbon with bronze star. No further changes be made to Petitioner’s record. A copy of this report of proceedings be filed in Petitioner’s naval record. Upon request, the VA beinformed that Petitioner’s application was received by the Board on 9 July 2018. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy.
