Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to an Enlistment Bonus for Ship (EBSHP). allegations of error and injustice on 26 February 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), to be eligible for EBSHP an initial classification or a reclassification must take place on or after 20 December 2017 with a ship date between January-May in fiscal year 2018. However, recruits that were in delayed entry/enlistment program (DEP) prior to 20 December 2017 would only be eligible if there was a change to their rate, program or shipping date. c. Petitioner excuted DD Form 4, Enlistment/Reenlistment Document on 10 August 2017 for a term of 8-year and entered into DEP with an estimated active duty start date of 2 April 2018. On the same date, Petitioner signed NAVCRUIT 1133/52, Enlistment Guarantees Annex “A” for the Quartermaster (QM/5YO) Class “A” School Gurantee (T+X). d. Petitioner signed NAVCRUIT 1133/52, Enlistment Guarantees Annex “B” on 23 January 2018 with a rate change to Logistics Specialist (LS/5YO) Class “A” School Guarantee (T+X), $5,000.00 Enlistment Bonus for Source Rate (EBSR) and $5,000.00 EBSHP. Note: Annex “B” incorrectly referenced Petitioner’s DD Form 4 date as 23 January 2018. e. Petitioner’s active duty service date is 7 February 2018. f. Petitioner’s Master Military Pay Account reflects a bonus payment of $5000.00 (before taxes) was authorized on 2 April 2018. g. Petitioner reported to Naval Mobile Construction Battalion 4 for duty on 10 July 2018. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the basic eligibility criteria to receive the EBSR and EBSHP in accordance with reference (b). However, because of an incorrect administrative entry on Annex “B”, Petitioner has only received one of the $5,000.00 bonuses. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, a measure of relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's NAVCRUIT 1133/52, Enlistment Guarantees Annex “B” to DD Form 4 dated 10 August 2017 vice 23 January 2018. This change will entitle Petitioner to $5,000.00 EBSR and $5,000.00 EBSHP. Note: Petitoner has received a $5,000.00 bonus payment. Defense Finance and Accounting Service will complete an audit of pay record to determine bonus pay due to Petitioner. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
