Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to transfer points from exam 14167F to anniversary year ending 24 May 2010 and be transferred to the Retired Reserve without pay. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 27 August 2020 pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner’s anniversary year ends on May 24th each year. b. On 27 May 2010, Petitioner completed correspondence course 14167F worth 8 Reserve retirement points. The points were credited to Petitioner’s anniversary year of 25 May 2010 through 24 May 2011. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. The Board concluded Petitioner completed the correspondence course with the belief that the Reserve retirement points would be credited toward the anniversary year ending on 24 May 2010. However, the Board found Petitioner had not exhausted his administrative recourse in requesting Reserve Retirement without pay; therefore, under these circumstances, partial relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Transfer eight Reserve retirements points from the anniversary year ending 24 May 2011 to the anniversary year ending 24 May 2010. This action will establish a qualifying year of service for anniversary year ending 24 May 2010. The part of Petitioner’s request for corrective action that exceeds the foregoing is denied. Petitioner has not taken all available avenues to request transfer to the Retired Reserve without pay. Retirement request must be submitted to Navy Personnel Command for adjudication. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
