Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to a Zone “B” Selective Reenlistment Bonus (SRB) and Early Reenlistment Kicker. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 14 February 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. c. Petitioner executed DD Form 4, Enlistment Reenlistment Document on 29 September 2018 for a term of 3-years and 10-weeks. Contract indicates Petitioner reenlisted for “Zone B SRBP Amount $23,625” (less applicable state and government taxes). Note: Marine Corps Total Force System (MCTFS) indicates Petitioner reenlisted on 29 September 2018 for a term of 4-years. d. Petitioner was promoted to Staff Sergeant on 1 November 2019. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner was limited to requesting to reenlist for 36-months as a result of the service limitations for Sergeants in reference (b), thereby restricting his ability to maximize the bonus authorization outlined in reference (c). Subsequently, reference (d), was published allowing for Sergeants to request a waiver up to 14-years of active service if favorably endorsed at the O-6 level. Had this waiver opportunity been available for Petitioner prior to reenlisting on 29 September 2018, he may have had the opportunity to reenlist for 48-months to receive the maximum SRB payment and the Early Reenlistment Kicker. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner completed the Fiscal Year 2019 (FY19) SRB Program Statement of Understanding and the FY19 Kicker Statement of Understanding. Petitioner executed DD Form 4, Enlistment/Reenlistment Document on 29 September 2018 for a term of 4-years and 10-months vice 3-years and 10-weeks. End of Active Service and End of Current Contract is 28 July 2023. Note: DD Form 4, Enlistment/Reenlistment Document, Paragraph 8b (Remarks) shall read “AUTHORITY: TFRS-13424087. REENLISTED FOR THE FOLLOWING INCENTIVE(S): ZONE B SRBP AMOUNT $31,500 AND EARLY REENLISTMET KICKER AMOUNT $10,000. PER MARADMIN 370/18 THIS MARINE IS ELIGILBE FOR A SELECTIVE REENLISTMENT BONUS (SRB) AND EARLY REENLISTMENT KICKER ESTIMATED AT $31,500 AND $10,000, LESS APPLICABLE STATE AND GOVERNMENT TAXES. Petitioner’s MCTFS is updated to reflect end of active service and end of current contract as 28 July 2023 vice 28 September 2022. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
