Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner reenlisted for 3 years and received a Selective Retention Bonus (SRB). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 24 November 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 28 July 2008, Petitioner enlisted for 8 years with an Expiration Of Obligated Service (EOS) of 27 July 2016. c. On 29 June 2009, Petitioner entered active duty. d. On 29 June 2013, Petitioner was honorably released from active duty and transferred to the Navy Reserve due to reduction in force. e. On 22 February 2016, Petitioner reenlisted for 4 years. f. In accordance with reference (b), NAT, Prior Service Affiliation, and Prior Service Enlistment Bonuses are governed by the Enlisted Bonus Program, Department of Defense Instruction (DoDI) 1304.31. NATs will incur a six-year SELRES obligation. The effective start date of this obligation will be the member's Pay Entry Base Date. Prior Service re-enlistment or affiliation will incur a three-year or six-year SELRES obligation, and all Prior Service Re-enlistment Eligibility Reserve (PRISE­R) candidates must obligate for six years to receive a bonus. SRB policy is governed by references (a) and (b). Members will incur a three-year or six-year SELRES obligation to receive a bonus, if eligible, in accordance with RESPERSMAN 1100-020, Reserve Enlisted Incentives. Selected Reenlistment Bonus (SRB) (per DoDI 1304.31). This bonus is intended for Selected Reserve Sailors to re-enlist with the Navy Reserve at their End of Obligated Service (EOS). SELRES Sailors must re-enlist in the same Fiscal Year as their EOS. Bonus Amount Variable (based on Rate and length of obligated service). 50% upon affiliation with the Navy Reserve, remainder paid in annual installments. Service Obligation: Six-year or three-year SELRES service from effective date. Termination-Recoupment: Failure to fulfill any program requirement will result in bonus termination and recoupment of a pro-rated portion of the total bonus paid. Petitioner was qualified for a zone “B” (Tier 3) SRB with an award payment of $5,000 for the IS rate for a 3 year reenlistment. g. On 10 May 2019, Petitioner submitted a drilling reservist worksheet (Reenlistment/Extension) for a 2 year reenlistment, and was approved by cognazant authority on 1 June 2019 with an EOS (Expiration of Obligated Service)/EREN (Expiration of Reserve Enlistment) of 21 February 2020. h. On 14 July 2019, Petitioner reenlisted for 2 years. i. In accordance with reference (c), NAT, Prior Service Affiliation, and Prior Service Enlistment Bonuses are governed by the Enlisted Bonus Program, Department of Defense Instruction 1304.31. NATs will incur a six-year SELRES obligation. The effective start date of this obligation will be the member's Pay Entry Base Date. Petitioner was qualified for a zone “B” (Tier 3) SRB with an award payment of $5,000 for the IS rate for a 3 year reenlistment. j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that due improper counseling, Petitioner did not reenlist long enough to receive an SRB. Furthermore, Petitioner was required to reenlist in the same Fiscal Year as his EOS. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 30 September/1 October 2019 vice on 13/14 July 2019 for a term of 3 years vice 2 years. Note: This change will entitle the member to a zone “B” (Tier 3) SRB with an award payment of $5,000 for the IS rate for a 3 year reenlistment. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
