Pursuant to the provisions of the reference, Petitioner a former enlisted member of the Navy, filed the enclosure with this Board requesting correction to the name listed on his Armed Forces of the United States Report of Transfer or Discharge (DD Form 214) from to 2. The Board, consisting of , , and reviewed Petitioner’s allegations of error and injustice on 26 August 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the enclosure was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the Navy and began a period of active duty on 5 September 1967. On 17 September 1970, Petitioner was discharged with an honorable characterization of service. d. Petitioner was issued an Armed Forces of the United States Report of Transfer or Discharge (DD Form 214) which incorrectly reflects the following name: . e. Petitioner contends his Americanized name was used for his enlistment. Petitioner provided a copy his Certificate of Birth, US Department of Veterans Affairs Identifications Card, Medicare Health Insurance ID that reflect his birth name: . CONCLUSION: Upon review and consideration of all the evidence of record, the Board determined that the Petitioner’s request warrants favorable action. The Board notes the Petitioner’s DD Form 214 incorrectly reflects Petitioner’s birth name. The Board notes that Petitioner has provided legal evidence, which reflects his correct birth name: . In view of the above, the Board directs the following corrective action. RECOMMENDATION: That Subject’s naval record, be corrected to reflect the correct name . That Subject be issued Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215) for period of active duty ending on 17 September 1970 to reflect Petitioner’s correct name: . That a copy of this Report of Proceedings be filed in Subject’s Naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received by the Board on 6 November 2019. 4.
