Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to adjust Active Duty Service Date (ADSD) in block (12a) on DD Form 214 issued on December 22, 1986 from “82 Dec 28” to “78 Dec 28”. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on May 21, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On December 9, 1978 Petitioner enlisted in Naval Reserve for 6 years with 4 years in U.S. Navy active component. c. Petitioner entered active duty service effective December 28, 1978. d. Petitioner’s official military personnel file (OMPF) does not reflect a DD Form 214 being issued prior to Petitioner’s reenlistment effective December 28, 1982. e. On December 22, 1986 Petitioner discharged effective this date. f. On December 30, 1986 Petitioner enlist in Naval Reserve for 2 years. g. On March 5, 1987 Petitioner reenlist in Naval Reserve for 6 years for enlistment in Regular component of the Navy effective June 1, 1987 for not less than 6 years. h. On June 1, 1987, Petitioner enters active duty service with U.S. Navy effective this date. i. On June 30, 1999 Petitioner is transferred to Fleet Reserve. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined the Petitioner did not receive a DD Form 214 for initial period of active duty from December 28, 1978 through December 27, 1982 (day prior) to reenlistment effective December 28, 1982 as required by reference (a). The Board concluded the Petitioner’s record of service be corrected with issuance of DDForm 214 for period of active duty served on first enlistment in the U.S. Navy. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner issued DD Form 214 for initial period of active duty service from December 28, 1978 through December 27, 1982 and make appropriate distribution. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
