Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to advance to E4 effective June 16, 2003 based on block 12h of DD Form 214 issued effective September 18, 2006. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on May 28, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. According with the Navy Standard Integrated Personnel System (NSIP), the following is the Petitioner’s advancement history during active duty service from November 19, 2001 through September 18, 2006. (1) Advanced to UTCA E2 effective September 16, 2002. (2) Advanced to UTCN E3 effective June 16, 2003 with time in rate date June 1, 2003. (3) Advanced to UT3 E4 effective September 16, 2006 with time in rate date July 1, 2006. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an administrative error and the following corrective action. The Board concluded that the Petitioner was not advanced to UT3 E4 on June 16, 2003 as indicated block 12h. The Board noted that Petitioner’s DD Form 214 issued effective September 18, 2006 was an administrative error by using the Petitioner’s UTCN E3 advancement date vice using the advancement to UT3 E4 effective September 16, 2006. Furthermore, the Board noted that back pay is not warranted because the Petitioner’s record indicated that the Petitioner’s UT3 E4 became effective September 16, 2006, and as such, all pay and entitlements followed this advancement. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: DD Form 215 issued correcting Block (12h) of DD Form 214 effective September 18, 2006 to read (06SEP16) vice (03JUN16) and appropriate distribution of DD Form 215 is made according with Navy directives. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
