Pursuant to the provisions of the reference, Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his/her naval record be corrected by removing his Administrative Remark (page 11) entries dated 3 March 2019, 27 March 2019, 12 August 2019, his rebuttal statement, and all duplicate entries from his official military personnel file (OMPF). 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 15 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 5 March 2019 , Petitioner was issued enclosure (2), a 6105 page 11 entry counseling him for failing to report for work at 0630 as he was ordered to do. b. On 27 March 2019, Petitioner was issued enclosure (3), a page 11 entry notifying him that he was being processed for administrative separation due to a pattern of misconduct. c. On 12 August 2019, Petitioner was issued enclosure (4), a page 11 entry notifying him that he was not recommended for reenlistment because of his administrative separation for a pattern of misconduct. d. On 30 August 2019, enclosure (5), the Commanding General (CG), rescinded his previous approval to administratively separate Petitioner for a pattern of misconduct. The CG noted that upon subsequent review of new information, the administrative separation did not meet the basis for separation and directed that Petitioner’s original end of active service date be reinstated. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an error warranting partial corrective action. In this regard, the Board noted that pursuant to the Marine Corps Individual Records and Administration Manual (IRAM), Petitioner was properly counseled on 5 March 2019 for failing to report and the entry was written and issued according to the IRAM. The Board also noted that the CG, rescinded Petitioner’s administrative separation after enclosures (3) and (4) were issued, therefore, according to the IRAM, “Do not make entries on page 11 which concern administrative discharge . . . if they do not, upon final review, result in discharge or reduction.” The Board thus determined that Petitioner’s 27 March 2019 and 12 August 2019 page 11 entries are in error and shall be removed. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner’s naval record be corrected by removing his 27 March 2019, Administrative Remarks (page 11) entry. Petitioner’s naval record be corrected by removing his 12 August 2019, Administrative Remarks (page 11) entry. Petitioner’s naval record be corrected by removing all duplicate Administrative Remarks (page 11) entries. No other changes to Petitioner’s record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
