Pursuant to the provisions of reference (a) Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to authorized Privately Owned Vehicle (POV), Transoceanic travel for Permanent Change of Station (PCS) from to during July 2019. 2. The Board reviewed Petitioner’s allegations of error and injustice on March 25, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On May 31, 2016, Petitioner joined by Office of . See enclosure (2) c. On November 13, 2018 Petitioner issued Consecutive Overseas Tour (COT) BUPERS Order 3178 for transfer to . See enclosure (3) d. Notes of interest from enclosure (3) (1) Detaching Command-delivering orders: (a) If transoceanic travel will be performed by member, port call assigned by the Navy Passenger Transportation office will cancel the report not later than (NLT) date, at receiving command, and shall constitute the specific date member is to report for transportation. (b) If member will be performing transoceanic/international travel at any time during execution of these orders, the following applies: Transportation must be arranged with the Navy passenger transportation office per NAVMILPERSCOMINST 4650.2 series. (c) If transoceanic/international travel is required to execute this PCS order, government air/government-procured air directed. (d) Dependent spouse and two dependent children authorized travel. (2) Member: Remember to read your orders in their entirety. e. On July 1, 2019, Petitioner detached from and was joined effective July 7, 2019 by . See enclosure (2) f. On August 12, 2019, DFAS-Cleveland paid Disbursing Office (DO) voucher number A34505. Petitioner received payment for one-day travel effective for July 7, 2019. POV travel not reimbursed due to member not providing appropriate authorization with travel claim. See enclosure (4) g. Petitioner contends that he and his family drove via vice utilizing commercial air travel and shipping their POV. He asserts utilizing overland travel was beneficial to him and his family while being advantageous to the government. Petitioner provided cost comparison document generated by a representative from the Pay and Personnel Division, . See enclosure (5) h. In correspondence attached as enclosure (6), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has no merit and warrants unfavorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosures, the Board finds the existence of an injustice warranting the following corrective action: The Board determined that per section 0502 of reference (b) in regards to Transoceanic Travel an Authorizing Official may authorize a Service Member or Dependent to use a POV on a route normally involving transoceanic travel if it is to the Government’s advantage. The cost of government procured air transportation and shipment of the family POV would have exceeded the cost of POV travel for distance estimated at 2500 kilometers. It is apparent the Petitioner and detaching command did not follow the instructions of enclosure (3). The Board concluded that the Petitioner be granted full relief as it is advantageous to the government. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Effective May 1, 2019, Petitioner requested and was granted authorization to conduct PCS travel from his detaching command located in to the gaining command in via POV as more advantageous to the government. Petitioner’s BUPERS Order 3178 of November 13, 2018 modified effective May 1, 2019 authorizing POV travel as more advantageous to the government. All travel charged to funding data provided on BUPERS Order 3178. Note: The appropriate service agency will provide the Petitioner with orders modification. Upon receipt of orders modification Petitioner will file supplemental travel claim within five working days via his local PSD. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
