Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to have Petitioner’s DD Form 214 show continuous active dutyfrom 9 August 1973 to 31 August 1992. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 10 March 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 6 July 1967, Petitioner entered active duty in the U.S. Navy, and was released from active duty and transferred to the Navy Reserve on 25 June 1971. c. On 9 August 1973, Petitioner entered active duty in the U.S. Navy, and was discharged on 28 September 1978. d. On 29 September 1978, Petitioner reenlisted in the U.S. Navy. e. On or about 2 April 1979, Petitioner was commissioned and entered active duty in the U.S. Navy. f. On 10 April 1979, Petitioner arrived to or duty under instruction. g. On 31 August 1992, Petitioner retired with over 20 years of active service. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner reenlisted on 29 September 1978 in the U.S. Navy, and was commissioned on or about 2 April 1979. Although a DD Form 214 should have been issued upon acceptance of his commission, none could be found in his Official Military Personnel File. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was issued a DD Form 214 (Certificate of Release or Discharge from Active duty), with a entered active duty date of 29 September 1978, and a separation date of 1 April 1979. Note: This period of service is already part of his retirement percentage multiplier. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
