Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received a Selective Retention Bonus (SRB) and Lateral Move(LM) initiative. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 15 December 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 21 July 2014, Petitioner entered active duty for 5 years. c. In accordance with reference (b), This bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2018 to 30 September 2019. Zone A Marines electing to LM in FY19 into PMOSs listed in section 3.m with the LM designation, will be given the opportunity to reenlist for 72 Months. Marines who execute a LM into one of these PMOSs for 72 months will rate a 40,000 dollar initiative in addition to the PMOS bonus listed in section 3.m. The LM initiative may not be coupled with any kicker. Zone A PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.j). Finally, a zone “A” SRB for MOS 0365LM, which is capped at $30,000 for 48 months of additional obligated service was authorized. d. On 1 August 2018, Petitioner was promoted to Sergeant/E-5. e. In accordance with reference (c), the FY19 SRB program will be terminated 30 days (29 June 2019) after the release of this MARADMIN. Marines with an ECC during FY19 will no longer be eligible for an SRB. A FY19 ECC is defined as any Marine who has an ECC on the date of reenlistment between 1 October 2018 and 30 September 2019. f. On 10 July 2019, Petitioner signed an agreement to extend enlistment for 1 month, awaiting response for RELM request submitted. g. On 5 August 2019, Petitioner’s 1st Term Active Duty Lateral Move was submitted, and was approved by HQMC on 13 August 2019. h. On 16 August 2019, Petitioner reenlisted for 4 years. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that prior to RELM being submitted, HQMC approval, and Petitioner’s reenlistment, SRB had been cancelled. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Agreement to Extend Enlistment (NAVMC 321A) executed on 10 July 2019, is null and void. The Petitioner was discharged and reenlisted on 27/28 June 2019, vice on 15/16 August 2019 for a term of 6 years vice 4 years. Note: This change will entitle the member to a zone “A” SRB for 0365LM, which is capped at $30,000 for 48 months of additional obligated service upon completion of training. Remaining obligated service to 20 July 2019 will be deducted from SRB computation. Additionally, Petitioner rates a $40,000 Lateral Move(LM) initiative. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
