Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reflect years of active service as 20 years, 6 months, and 4 days. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 25 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 27 May 1952, Petitioner enlisted for 4 years in the U.S Navy, and on 17 May 1956, Petitioner was discharged. b. On 18 May 1956, Petitioner reenlisted for 4 years in the U.S. Navy, and on 18 August 1958, Petitioner was discharged. c. On 19 August 1958, Petitioner reenlisted for 6 years in the U.S. Navy, and on 9 August 1962, Petitioner was discharged in order to accept a commission as an Officer in the U.S. Navy. d. On 10 August 1962, Petitioner was commissioned as an Ensign in the U.S. Navy with a designator code of 1350. e. On 30 November 1972, Petitioner was transferred to the retired list with grade of LCDR and with retired pay of that grade pursuant to provisions of 10 USC 6323. Petitioner completed 20 years, 6 months, and 4 days of active service. f. On 9 August 2019, Petitioner received a letter from the Defense Finance and Accounting Service (DFAS) notifying him that an audit of his military retirement fund data had been conducted. It listed 20 years, 0 months, and 1 day of active service. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded the Petitioner’s naval record is correct. Petitioner served continuously on active duty from 27 May 1952 to 30 November 1972 for a period of 20 years, 06 months, and 04 days. RECOMMENDATION That Petitioner’s naval record where appropriate, to show that: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. Petitioner’s total active service is 20 years, 06 months, and 04 days. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy.
