Pursuant to the provisions of reference (a), Petitioner, a former enlisted member of the Navy, filed enclosure (1) with this Board requesting that his Certificate of Release or Discharge from Active Duty (DD Form 214) be corrected to upgrade his reentry code and the discharge code be changed. 2. The Board, consisting of , , and reviewed Petitioner's allegations of error and injustice on 13 July 2020 and, pursuant to its regulations, determined the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval records, and applicable statutes, regulations, policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to waive the statute of limitations and review the application on its merits. c. Petitioner enlisted in the Navy and began a period of active duty on 14 June 2004. On 21 October 2004, Petitioner was diagnosed with Adjustment Disorder with Depressed Mood, Unspecified, Personality Disorder and Occupation Stressor. Subsequently, Petitioner was notified of pending administrative separation action by reason of Personality Disorder, at which time Petitioner waived his procedural rights to consult with counsel and to present his case to an administrative discharge board. The commanding officer recommended an Entry-Level Separation. The Separation Authority approved this recommendation and directed an Entry-Level Separation by reason of Personality Disorder. The Petitioner was discharged 8 November 2004. d. Petitioner stated that he doesn’t have the issue the code [reentry code], he wanted to leave for a funeral and was labeled depressed, wants to rejoin the military and this is in his way, he is willing to meet with a doctor for a waiver or change. CONCLUSION Upon review and consideration of all the evidence of record, the Board concluded that Petitioner’s request warrants partial relief. The Board noted in the interest of justice and in light of the potential for future negative implications, the Board determined Petitioner’s narrative reason, separation code, and separation authority should be changed to secretarial authority. The Board denied Petitioner’s request to change his reentry code. The Board noted Petitioner’s reentry code of RE-3G may be waived by a recruiting command and recommended Petitioner seek such waiver by contacting his local recruiting office. RECOMMENDATION In view of the foregoing, the Board finds clemency warrants the following corrective action. Petitioner be issued a new Certificate of Release or Discharge from Active Duty (DD Form 214) indicating the narrative reason for separation as secretarial authority, separation code as JFF, and separation authority as MILPERSMAN 1910-164. No further changes be made to Petitioner’s record. A copy of this report of proceedings be filed in Petitioner’s naval record. Upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received by the Board on 2 December 2019. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of the reference, has been approved by the Board on behalf of the Secretary of the Navy.
