Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show advancement from E-2 to E-3, E-3 to E-4, and E-5 comparison to any/all missed cycles. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 31 May 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 16 June 2016, Petitioner entered an Enlistment Guarantee; Advance Electronics Field – Computer Filed (AEF/AECF 6YO) program. c. On 28 June 2016, Annex A was superseded by Annex B and Petitioner entered an Enlistment Guarantee; Nuclear Field (NF 6YO) program. d. On 5 December 2016, Petitioner entered active duty. e. On 28 January 2017, Petitioner graduated from Recruit training. f. On 12 April 2017, Petitioner dropped from the Nuclear Field (NF 6YO) program. g. On 6 December 2017, Petitioner graduated from “A” school and was Honor graduate. Furthermore, is part of the Advance Electronics Field – Computer Filed (AEF/AECF 6YO) program h. On 11 December 2018, Petitioner completed the Petty Officer Selectee Leadership Course. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following partial corrective action. Petitioner was enrolled in the Advanced Electronic Field (AEF). Personnel enrolled in these programs are authorized accelerated advancement to pay grade E-2 upon completion of recruit training. Promotion to E-3 should have taken place 9 months from his TIR. For promotion to E-4 should have taken place 6 months from his TIR. It also required completion of Petty Officer Indoctrination, a Special Request/Authorization approval signed by his Commanding Officer, which is missing; however, the Board felt that under these circumstances, a measure of relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner advanced to E-2 effective “28 January 2017” vice “24 April 2017” with a time in rate of “1 February 2017”. Petitioner advanced to E-3 effective “16 November 2017” vice “16 February 2018” with a time in rate of “1 November 2017”. Petitioner advanced to E-4 effective “11 December 2018” with a time in rate date of “1 July 2018”. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. That part of the Petitioner's request for corrective action that exceeds the foregoing be denied. Petitioner has not met E-5 requirements at this time. No exam exists. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy. 10/8/2019
