Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to be promoted to the paygrade of E-5 (Sergeant). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 6 September 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of the Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action: Petitioner served in Primary Military Occupational Specialty (PMOS) 6046, and Petitioner obtained a composite score of 1663 for the 3RD Quarter. The cutting score for PMOS 6046 was listed as 1659 on September 2000. Hence, Petitioner met the promotion requirement for the paygrade of E-5 on 1 September 2000. However, Petitioner End of Active Service was 5 September 2000. Petitioner did not receive promotion due to an administrative oversight. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was promoted to the paygrade of E-5 in the PMOS of 6046, effective on 1 September 2000. That Petitioner be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215) to indicate that Block 4a reflect SGT vice CPL, Block 4b reflect E-5 vice E-4, and Block 12h reflect 1 September 2000. The Defense Finance and Accounting Services (DFAS) will conduct an audit of Petitioner’s pay account and reimburse pay and/or entitlements for the paygrade of E-5 effective 1 September 2000. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
