After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. Although you did not file your application in a timely manner, the Board found it in the interest of justice to waive the statute of limitations and consider your application on its merits. A three-member panel of the Board, sitting in executive session, considered your application on . The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record, and applicable statutes, regulations, and policies. You enlisted in the Marine Corps and began a period of active duty on You served two years without disciplinary incident. On you received nonjudicial punishment (NJP) for wrongfully cohabitating with a woman not your wife. You were counseled for the NJP on you counseled three more times for various areas of deficiency including failure to adhere to the United States Marine Corps height and weight standards, unsatisfactory performance while assigned to the Body Composition Program (BCP), and failure to pass the physical readiness test. You completed your active duty assignment with proficiency and conduct marks of 3.9/3.9. You were discharged from the Marine Corps on after completion of required active service and received a general characterization of service and a reentry (RE) code of RE-3P. You request an upgrade to your characterization from general to honorable. You state that you were discharged due to being overweight and that you participated in the BCP. You note that you served your full length of enlistment and that you were not recommended for retention due to body fat. You also note that you paid into the GI Bill but that you cannot use it because of the general discharge characterization. You provide a letter of recommendation from the United States Marine Corps League noting that you are honest, dependable, incredibly hard working, and an impressive problem solver. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, including the letter of recommendation you provided, as well as your completion of your active duty enlistment contract. The Board also took into consideration your proficiency and conduct marks, and noted that they are under the required 4.0 marks needed for an honorable characterization of service. Based on the counseling entries reflected in your service record and your overall performance marks, the Board found that, even in consideration of your post service accomplishments, your general characterization of service is appropriate. Accordingly, the Board determined that no corrective action is warranted. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon the submission of new matters, which will require you to complete and submit a new DD Form 149.
