After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found that the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 25 February 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record, and applicable statutes, regulations and policies, as well as the enclosed 28 May 2019 advisory opinion (AO) furnished by the Navy Physical Readiness Program Office (PRPO N170) and your response. The Board carefully considered your request to update the Physical Readiness Information Management System (PRIMS) to reflect “excused” for your cycle 1-2017 and cycle 2-2018 Physical Readiness Test (PRT). The Board considered your contention that your cycle 1-2017 PRT should have been waived because you were assigned to your command for less than 90 days and the Command Fitness Leader (CFL) lost your cycle 2-2018 PRT scoresheet. The Board, however, substantially concurred with the AO that your application did not contain documentation to support your request. In this regard, the AO explained that, although your commanding officer (CO) is permitted to excuse you from taking the PRT, the Board found no evidence of correspondence from your CO, and you provided none. The Board noted the Fleet Readiness Center West Detachment (FRCWD) Fallon Notice 6110 that excused personnel reporting on or after 21 April 2017 from taking the PRT. The Board also noted that, according to your assignment history, you joined the command on 20 April 2017 and were therefore required to participate in the cycle 1-2017 PRT. The Board noted, too, that your body composition assessment (BCA) for cycle 2-2018 is incomplete—specifically, your scoresheet does not contain the signature of the CFL—and the Board found no evidence excusing you from taking the 2-2018 PRT. The Board thus concluded that there is no probable material error or injustice warranting corrective action. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
