Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to adjust Petitioner’s Active Duty Service Date (ADSD) to reflect 3 September 2004. 2. The Board, consisting of , reviewed Petitioner’s request on May 17, 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner completed a period of service of 5 February 2001 to 12 August 2011. c. Petitioner was credited with 15 AT/ADT points during the period of 2 February 2012 to 1 February 2013. d. Petitioner completed a period of service of 4 April 2013 to 7 May 2014. e. Petitioner was credited with 13 AT/ADT points during the period of 2 February 2015 to 1 February 2016. f. On 15 April 2016, Petitioner reenlisted in the U.S. Navy for 4 years. Furthermore, Petitioner’s ADSD listed 7 October 2005. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. Upon Petitioner’s 15 April 2016 reenlistment, his ADSD was erroneously calculated. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The immediate reenlistment contract (NAVPERS 1070/601), executed on 15 April 2016 for 4 years is modified to read ADSD 5 August 2004 vice 7 October 2005. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
