Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received Basic Allowance for Housing (BAH) while stationed in 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 13 September 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under b. On 28 July 2017, Petitioner transferred from c. On 6 August 2017, Petitioner signed a lease with more than a year. d. On 28 October 2017, Petitioner arrived to for duty. e. On 8 March 2018, Petitioner was issued official homeport shift orders (BUPERS order:0678)with an effective date of 1 September 2018. was 1 March 2018. f. On or about 3 August 2018, Petitioner arranged a Household move effective 30 August 2018. g. On 30 September 2018, Petitioner began to receive BAH at the without dependents rate for CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that the Petitioner was entitled to BAH at the without dependents rate for ; however, due to an administrative oversight, Petitioner’s BAH was never started. However, upon the completion of his official homeport shift orders he began to receive BAH at the without dependents rate for RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was authorized BAH at the without dependents rate for , from 28 October 2017 to 31 August 2018. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
