Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to receive Basic Allowance for Housing (BAH) at the dependent location from 7 January 2016 through 3 January 2018 at zip code . 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 5 May 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 10 February 2014, Petitioner acquired a dependent through marriage. c. On 17 June 2015, Petitioner was issued BUPERS Order 1685; one year dependent restricted. d. On 1 October 2015, Petitioner executed BUPERS Order 1685. e. On 7 January 2016, Petitioner reported to Marine Corps Air Station (MCAS), . f. On 20 November 2017, Petitioner’s divorce is finalized. g. On 23 December 2017, Petitioner detached MCAS . h. On 4 January 2018, Petitioner reported to CONCLUSION Upon review and consideration of all the evidence of record, the Board agreed that Petitioner was issued a one year unaccompanied tour overseas and rated BAH at the dependent location during his tour overseas until the date before his divorce. The Board finds the existence of a partial injustice warranting the following partial corrective action. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner is entitled to BAH at the with-dependent rate from 7 January 2016 to 19 November 2017; for zip code Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
