Pursuant to reference (a), Petitioner, a former enlisted Marine, filed the enclosure with the Board for Correction of Naval Records (Board) requesting a change to his Certificate of Release or Discharge from Active Duty (DD Form 214) to reflect his entitlement to the Presidential Unit Citation Ribbon and promotion to sergeant/E-5. 2. The Board consisting of , received Petitioner’s allegations of error and injustice on 6 February 2020, and, pursuant to its regulations, determined the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, and applicable statutes, regulations, policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the enclosure was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the Marine Corps on 12 June 2006 and served honorably until the completion of his required active service on 11 June 2011. Petitioner’s DD Form 214 lists the following awards: Combat Action Ribbon, Marine Corps Good Conduct Medal, Sea Service Deployment Ribbon, Afghanistan Campaign Medal (with one bronze service star), Global War on Terrorism Service Medal, National Defense Service Medal, Navy Unit Commendation, and NATO Medal-ISAF Afghanistan. At the time of his discharge, Petitioner was serving as a corporal/E-4. d. A review of Petitioner’s record shows that, in addition to the awards listed on his DD Form 214, he is entitled to the Presidential Unit Citation Ribbon. Per reference (b), personnel permanently assigned to or attached to Marine Expeditionary Brigade-Afghanistan, who were present in Afghanistan and participated in the actions for which the unit was cited, are authorized to wear the Presidential Unit Citation Ribbon. Per reference (b), 1st Battalion, 6th Marines is eligible for the Presidential Unit Citation Ribbon. Petitioner was assigned to 1st Battalion, 6th Marines from December 2009 to March 2010 during the timeframe prescribed by reference (b). e. A review of Petitioner’s record reflects he was promoted to sergeant/E-5 on 1 October 2011, while serving in the Reserve of the Marine Corps, but after his discharge from active duty. CONCLUSION: Upon review and consideration of the evidence of record, the Board determined Petitioner’s request warrants partial relief. The Board determined Petitioner is entitled to wear the Presidential Unit Citation Ribbon for his service with 1st Battalion, 6th Marines from December 2009 to March 2010. The Board, noting Petitioner was promoted to sergeant/E-5 after his discharge from active duty and while in the reserves, concluded there is no error or injustice on his current DD Form 214 because it correctly reflects Petitioner’s rank at the time of his discharge from active duty. RECOMMENDATION: In view of the above, the Board directs the following corrective action: That Petitioner be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215), to indicate the addition of the Presidential Unit Citation Ribbon. That no further changes be made to Petitioner’s record. That a copy of this report of proceedings be filed in Petitioner’s naval record. That upon request, the VA be informed that Petitioner’s application was received by the Board on 12 March 2019. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
