After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 11 February 2020. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. On 20 August 1986, you enlisted in the U.S. Navy Reserve. On 1 December 1986, you entered active duty in the U.S. Navy. On 24 August 1988, you were discharged in order to enter Naval Reserve Officer Training Program. On 26 May 1990, you were commissioned as an Ensign in the U.S. Navy. On 29 February 1996, you resigned. On 1 March 1996, you were appointed as a Lieutenant in the U.S. Navy Reserve. On 1 December 1996, you entered active duty in the U.S. Navy Reserve. On 15 December 2000, you were appointed as a Lieutenant Commander in the U.S. Navy. On 30 June 2019, you retired. You requested that your Pay Entry Base Date (PEBD), Active Duty Service Date (ADSD), and Active Commissioned Base Date (ACBD) to the initially assigned dates; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. Title 10 USC section 2107 states that in computing length of service for any purpose, an officer appointed under this section may not be credited with service either as a cadet or midshipman or concurrent enlisted service, other than concurrent enlisted service performed on or after 1 August 1979, as a member of the Selected Reserve. The Board concluded that the periods of 20 August 1986 to 30 November 1986 and 25 August 1988 to 25 May 1990 did not count for Pay Entry Base Date (PEBD) purposes. MILPERSMAN 1000-030 states that the ADSD is the actual or adjusted date from which the amount of active military service performed is calculated. The ADSD reflects all periods of active federal military service in commissioned officer, warrant officer, or enlisted status. The Board concluded that the periods of 20 August 1986 to 30 November 1986 and 25 August 1988 to 25 May 1990 and 1 March 1996 to 30 November 1996 did not count for ADSD purposes. MILPERSMAN 1920-190 states that ACBD is the date when all active commissioned service in any of the U.S. Armed Services and their Reserve components (RC) began, if service was continuous to present. The Board concluded that the period of 1 March 1996 to 30 November 1996 did not count for ACBD purposes. Regarding your request for a personal appearance, the Board determined that a personal appearance with or without counsel will not materially add to their understanding of the issue(s) involved. Therefore, the Board determined that a personal appearance was not necessary and considered your case based on the evidence of record. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records.
