Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner reenlisted and was advanced under the provisions of the Selective Training and Reenlistment (STAR) program. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 28 May 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 10 September 2013, Petitioner entered active duty. c. On 24 April 2015, Petitioner completed the Medical Laboratory Technician course. Furthermore, Petitioner earned NEC L31A (8506) listed in the Current Career School Listing (CSL) for STAR. d. On 16 March 2017, Petitioner was advanced to E-4. e. On 10 August 2018, Petitioner reenlisted for 3 years. Furthermore, Petitioner received a zone “A” Selective Reenlistment Bonus (SRB) with an award level of 2.0 for NEC L31A. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner meet all requirements for the STAR program; however, due to improper counseling Petitioner reenlisted without STAR submission or approval. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Immediate Reenlistment Contract (NAVPERS 1070/601) executed on 10 August 2018 for a term of 5 years vice 3 years, listed “Career designated under MILPERSMAN 1160-100”. Petitioner was advanced to Petty Officer Second Class effective 10 August 2018. Note: Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. Furthermore, Petitioner will be eligible for 48 months vice 35 months of SRB. The 25 month agreement to extend enlistment (NAVPERS 1070/621) operative on 10 August 2021 was cancelled. The agreement to extend enlistment (NAVPERS 1070/621) operative on 10 August 2023 was for 1 month. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
