Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to Zone “B” Selective Reenlistment Bonus (SRB). 2. The Board reviewed Petitioner’s allegations of error and injustice on 14 April 2020 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), SRB award levels are changed in response to market forces as retention changes in ratings, Navy Enlisted Classifications (NECs) and skills. Changes to the list of SRB eligible ratings/NECs/skills and respective award levels will normally be promulgated by naval message. However, current SRB messages direct members to BUPERS-328 website for addendums to the current award message posted to the site. These addendums provide notification of skill closures and supersede the current Navy Administrative message. b. On 17 August 2018, Petitioner requested to reenlist on 14 March 2019 for a term of 6-years. At the time Petitioner submitted his request to reenlist, reference (c) indicated he was eligible for a Tier Three, Zone “B” SRB with an award level of 1.5 ($30,000 award ceiling). See enclosure (2) c. Petitioner reenlisted on 14 March 2019 for a term of 6-years. However, reference (c) was superceded by references (d) and (e), reducing the award leved from 1.5 to 1.0, to 0.0 at the time of reenlistment. See enclosure (3) d. The Bureau of Naval Personnel (BUPERS-328) provided an advisory opinion recommending denial based on reference (e) reducing the award level to 0.0 and Petitioner was not approved for an SRB prior to the reduction. See enclosure (4) e. Petitioner provided a statement in response to BUPERS-328 findings. Petitioner asserts because of his Command Career Counselor’s administrative error, he was denied the requested SRB. See enclosure (5) CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of error and injustices, and unanimously concluded Petitioner’s request warrants favorable corrective action. Petitioner executed a 6-year reenlistment on 14 March 2019 with the intent to received and maximize SRB entitlement in accordance with reference (c). However, Petitoner’s Command failed to submit the SRB pre-certification in accordance with reference (c), thereby rendering him ineligible for an SRB at the time of his reenlistment. The Board concluded that had the Command obtained the SRB quota prior to Petitioner reenlisting, he would not have been affected by references (d) and (e), therefore under these circumstances, full relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: SRB request was submitted, received and approved by cognizant authority via Officer Personnel Information System (OPINS)/ Navy Standard Integrated Personnel System (NSIPS) 120 days in advance of Petitioner's requested reenlistment date of 14 March 2019 for a term of 6-years. Note: Petitioner reenlisted on 14 March 2019 for a term of 6-years. This change will entitle the Petitioner to a Tier Three, Zone “B” SRB with an award level of 1.5 ($30,000 award ceiling) for the Logistics Specialist (LS) rating. Remaining obligated service to 19 March 2019 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. Pursuant to Section 6(c) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(c)) it is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
