Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to pay missing Cost of Living Allowance (COLA) at the with dependent rate for spouse residing in from September 29, 2016 to December 6, 2017. 2. The Board, consisting of M , reviewed Petitioner’s allegations of error and injustice on January 17, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Cost of Living Allowance (COLA) is authorized to assist a member in maintaining the purchasing power of the discretionary portion of spendable income while assigned to an OCONUS PDS. COLA is derived by comparing the OCONUS cost of living with the CONUS cost of living. OCONUS COLA regulations are under Station Allowances in chapter 9 of reference (b). c. On September 2, 2014, Petitioner reported and was joined to as directed by BUPERS Order 0784. d. Petitioner marries dependent spouse on July 9, 2016. e. On September 21, 2016, Petitioner issued BUPERS Order 2656 to detach and report to . f. On September 29, 2016, OPNAV N130/C authorizes Petitioner continuation of housing allowances for dependents at previous duty station while assigned to . g. On November 4, 2016, Petitioner is detached from and is joined to . h. On November 16, 2017, Petitioner is detached from and is joined by on December 7, 2017. i. On January 2, 2018, OPNAV N130/C authorizes the continuation of housing allowances for dependents old permanent duty station , incident to unaccompanied assignment to . j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. They stated a review of the Petitioner’s Defense Joint Military System pay account indicates the Petitioner was paid COLA “0” for vice COLA “1” for from November 5, 2016 to November 15, 2017. Per the Joint Travel Regulations, paragraph 090103 A2, authorizes continuation of COLA when approved by the Secretary concerned. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that since the Petitioner was granted continuation of Cost of Living Allowances at the dependent spouse location Singapore there should have been no interruption of entitlement. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner authorized continuation of COLA at the dependents location from November 5, 2016 (day after detachment), through December 6, 2017 (day prior to reporting) to . Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
