Pursuant to the provisions of references (a), Petitioner, a former enlisted member of the Marine Corps, filed enclosure (1) with this Board requesting a change to his naval record, specifically, a correction to his date of birth on his Certificate of Release or Discharge from Active Duty (DD Form 214). Enclosures (1) and (2) apply. 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 8 April 2019, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval record, applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner served in the Marine Corps from March 1978 until August 1982, when he was discharged at the expiration of his required active service with an honorable characterization of service. d. At the time of his discharge, he was issued a DD Form 214 reflecting a date of birth of . e. In his application for correction, Petitioner states his correct date of birth is , and that the date on his DD Form 214 is a clerical error. Petitioner provides a copy of his birth certificate from the that indicates that his correct birth date is . CONCLUSION: Upon review and consideration of all the evidence of record, the Board concludes that Petitioner's request warrants favorable action. The Board notes that Petitioner has provided evidence to support his request, and as such, his record should be corrected to reflect his date of birth to be . In view of the above, the Board directs the following corrective action: RECOMMENDATION: That Petitioner be issued a Correction to DD Form 214 Certificate of Release or Discharge from Active Duty (DD Form 215) to indicate that his date of birth is . That a copy of this report of proceedings be filed in Petitioner's naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner's application was received by the Board on April 2019. 4.
