After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 19 November 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record, as well as applicable statutes, regulations, and policies. In addition, the Board considered the 23 July 2019 advisory opinion contained in Chief, Bureau of Medicine and Surgery letter 5400 Ser M1/19UM10034, which was previously provided to you for comment. On 8 November 2015, you graduated from nursing school. On 29 December 2017, your Nurse Corps Entry Grade Credit (EGC) worksheet was completed by the Professional Review Board (PRB). On 13 June 2018, you were commissioned. You request to recalculate your issued rank and credit as correct nursing experience because it does not accurately reflect all nursing experience due to the missing time frame between December 2017 and August 2018. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. According to the AO, your EGC and Memorandum of Understanding for Initial Date of Rank were not updated to reflect the new date of selection for commission. The calculations would have been from 12 June 2018, giving you an ensign date of rank of 10 March 2017, with a total of 1 year, 3 months, and 2 days of constructive credit including the requested credit. Because your DOR was as of the original PRB, you promoted to LTJG early and additional EGC is not warranted. The Board substantially concurred with the comments contained in the advisory opinion and concluded that the Navy offered you the authorized EGC based upon the PRB in accordance with OPNAVINST 1120.7A; therefore, relief is not warranted. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon the submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
