After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. You arrived to on 7 August 2015 and assigned to the . On 31 August 2018, you were issued Official Homeport Shift Orders (BUPERS Order: 2438) from to with an arrival date of 17 January 2019. On 16 January 2019, you Basic Allowance for Housing (BAH) was stopped. On 7 March 2019, you submitted a special request/authorization requesting continuation of single E-5 BAH. On 19 March 2019, Naval Base unaccompanied housing verified that you had never resided in unaccompanied housing at Naval Base . On 27 March 2019, Installation Housing Director approved your BAH and effective 20 February 2019 your BAH began. You requested BAH for the period of 17 January 2019 to 19 February 2019. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that per OPNAVINST 7220.12 Commanding officer allows a member to reside off the ship; however, the shore-based facility commander shall make the determination whether the member will be berthed in single bachelor quarters or entitled to draw an off-base housing allowance. In your case, the shore-based facility commander approved your BAH effective 20 February 2019. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records.
