Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to modify Petitioner’s home of record (HOR) to reflect effective 6 May 2018. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 7 June 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 1 November 2016, Petitioner received orders for active duty for training for the period of 21 November 2016 to 10 April 2017 (141 days). Petitioner’s address was c. On 29 November 2016, Petitioner received modification for active duty for training for a period of 21 November 2016 to 30 September 2017 (314 days). Petitioner’s address was d. On 30 September 2017, Petitioner was released from active duty and transferred to the Navy Reserve. Petitioner’s HOR was e. On 12 October 2017, Petitioner was received orders for annual training for the period of 15 October 2017 to 28 October 2017 (14 days). Petitioner’s address was f. On 14 November 2017, Petitioner received orders for active duty for training for the period of 20 November 2017 to 30 September 2018 (315 days). Petitioner’s address was g. On 10 January 2018, Petitioner received official recall to active duty orders (BUPERS mobilization order: 0108) for a period of 302 days. Petitioner’s address was h. On 12 February 2018, Petitioner received orders for active duty for training for the period 20 November 2017 to 30 April 2018 (162 days). Petitioner’s address i. On 5 November 2018, Petitioner received official recall to active duty orders (BUPERS mobilization order: 3098) for a period of up to 365 days. Petitioner’s address was CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. Prior to BUPERS mobilization orders (0108) being executed, a gap in service existed from 1 May 2018 to 31 May 2018. Therefore, Petitioner had the opportunity to change Place Last Entered active duty (PLEAD). RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner, prior to executing official recall to active duty orders (BUPERS mobilization order: 0108), submitted a PLEAD request listing Petitioner’s official recall to active duty orders (BUPERS mobilization order: 0108) address prior to executing of his orders were modified to read ” Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
